PLEASE READ THESE TERMS CAREFULLY. By accessing or using the Site, registering for our services, or participating in any promotions, giveaways, or reward programs offered (collectively, the "Services"), you agree to be bound by these Terms and Conditions ("Terms") and our Privacy Policy.

1. MANDATORY ARBITRATION & CLASS ACTION WAIVER

a. Binding Arbitration. You and Untapped Surveys agree that any dispute, claim, or controversy arising out of or relating to your use of the Site, the Services, these Terms, or the receipt of any emails, text messages, or phone calls from us or our Marketing Partners, shall be resolved exclusively by binding individual arbitration and not in a court of law. The arbitration shall be conducted by a neutral arbitrator in accordance with the American Arbitration Association ("AAA") rules.

b. Class Action Waiver. You and Untapped Surveys agree that each may bring claims against the other only in your or its individual capacity and not as a plaintiff or class member in any purported class or representative proceeding. Unless both you and Untapped Surveys agree otherwise, the arbitrator may not consolidate more than one person’s claims.

c. Opt-Out. You may opt-out of this Arbitration Agreement by providing written notice of your decision to do so within thirty (30) days of the date that you first register on the Site. Notice must be mailed to: UntappedSurveys.com, 8751 S. Sandy Parkway, Sandy, UT 84070.

2. ELIGIBILITY

The Site and Services are available only to individuals who are:

• Legal residents of the United States.
• At least eighteen (18) years of age (or the age of majority in their jurisdiction of residence).
• Capable of entering into a legally binding contract.

By using the Site, you represent and warrant that you meet all eligibility requirements. If you provide any false information, we reserve the right to suspend or terminate your account and forfeit any accrued rewards.

3. HOW THE SERVICES WORK

a. Samples and Rewards. UntappedSurveys.com connects users with third-party offers, samples, and reward opportunities. To qualify for certain rewards or samples, you may be required to:

1. Complete a registration form with accurate personal information.
2. Complete a specific number of "Deals" or "Offers" (e.g., paid offers, subscription trials, app downloads) from our advertising partners.
3. Complete the claims verification process, which may include ID verification.

b. No Guarantee of Availability. All third-party offers, samples, and giveaways are subject to availability. Untapped Surveys does not guarantee that any specific sample or reward will be available at any given time. We reserve the right to substitute a reward of equal or greater value if a specific item is unavailable.

c. Third-Party Merchants. We are not responsible for the products, services, or fulfillment of offers provided by third-party merchants ("Merchants"). Any transaction or interaction you have with a Merchant found through our Site is solely between you and that Merchant.

4. TELEMARKETING AND SMS CONSENT

By registering on the Site and submitting your telephone number, you provide your express written consent to receive marketing telephone calls and/or SMS text messages from UntappedSurveys.com and our Marketing Partners, potentially using an automatic telephone dialing system or prerecorded voice.

• Consent is not a condition of purchase. You may revoke your consent at any time by following the opt-out instructions provided in the message (e.g., replying "STOP") or by contacting us directly.
• Standard message and data rates may apply.

5. USER CONDUCT AND FRAUD PREVENTION

You agree not to:

• Use any robot, spider, scraper, or other automated means to access the Site.
• Create multiple accounts or use a fake identity to complete offers.
• Tamper with the operation of the Site or the Services.

Fraud Policy: We have zero tolerance for fraud. If we suspect fraudulent activity (e.g., using a VPN/proxy, completing offers with false info), we may immediately terminate your account and void all pending rewards or samples without notice.

6. INTELLECTUAL PROPERTY

The content, organization, graphics, design, and other matters related to the Site are protected under applicable copyrights and trademarks. The name "UntappedSurveys.com" and our logos are trademarks of Untapped Surveys. You may not copy, redistribute, or publish any part of the Site without our express written permission.

7. DISCLAIMER OF WARRANTIES

8. LIMITATION OF LIABILITY

IN NO EVENT SHALL OUR AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE LESSER OF: (A) THE AMOUNT YOU HAVE PAID TO US IN THE LAST 12 MONTHS, OR (B) $500.00 USD.
